As part of Convertr's operational organization, necessary access to this data for the execution of services under the Platform component or the Professional Services component is governed by the applicable contractual documentation, the granted permissions, confidentiality commitments, and security measures in place.

When personal data is likely to be processed outside the European Economic Area, Convertr applies the appropriate transfer mechanism to the specific case, such as an adequacy decision when applicable, or appropriate contractual guarantees supplemented, when required, by complementary technical, organizational, or contractual measures.

The exact mechanism utilized may depend on the specific provider, their location, the service setup, and the activated features.

13. DISTINCT SERVICES & SEPARATE INVOICING

The Convertr service is based on a contractual and operational structure in two distinct and complementary components:

• a Convertr Platform component, corresponding to the license, subscription, access to the platform, and its operation;
• a Convertr Professional Services component, corresponding notably to onboarding, integration, configuration, training, operational support, advertising marketing, maintenance, or reinforced support.

The Convertr Platform component is provided and invoiced by Mr. Samy BOUSSOUF, Individual Entrepreneur.

The Convertr Professional Services component is provided and invoiced by Mr. Adel BELGROUN, Individual Entrepreneur, according to the terms specified in the applicable contractual documents.

The Convertr commercial relationship incorporates this dual-billing organization, with each component generating its own invoice according to the scope stated in the quote, the purchase order, special conditions and, more generally, the applicable contractual documents.

The exact scope of the services, deliverables, intervention methods, deadlines, financial conditions, support, and allocation of responsibilities are detailed in the applicable contractual documents.

The provider in charge of the Convertr Platform and the provider in charge of the Convertr Professional Services are legally distinct actors. Each acts in their own name, invoices their own scope, bears their own obligations, and is solely accountable for the services they execute.

Their joint intervention within the Convertr solution does not, in itself, establish a general joint liability, indivisibility, general mandate, or joint responsibility beyond what arises from the applicable contractual documents and mandatory legal rules.

When access to the platform or to data is necessary to execute the Convertr Professional Services, this access takes place to the extent necessary to perform the concerned service, subject to appropriate permissions, confidentiality requirements, suitable security safeguards, and, where personal data is involved, compliance with the applicable contractual documentation.

The Convertr T&Cs remain applicable to the Convertr Platform component. The services falling under the Convertr Professional Services component are governed by the contractual documents relevant to this component.
